TapHigh Terms of Service

Please read these Terms of Service ("Terms") carefully before using the TapHigh iOS keyboard application ("the App"). By accessing or using the App, you agree to be bound by these Terms.

1. License to Use the App

TapHigh grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on a single iOS device owned or controlled by you, subject to the purchase of the premium features via the App Store.

2. Usage Restrictions

You agree not to:

  • Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the App.
  • Use the App in any manner that could damage, disable, overburden, or impair the App or its underlying service.
  • Use the AI Text Art Generator (powered by Gemini) to generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or racially or ethically objectionable.
  • Distribute or sublicense the App to any third party.

3. Premium Features and Payment

The App is offered with a one-time purchase model for premium features (themes, full Kaomoji library, unlimited AI Text Art generation). All payments are processed securely through the Apple App Store, and we do not store any payment information.

The purchase entitles you to all future updates and content releases for the App.

4. Intellectual Property

The App, its original content (excluding user-generated Text Art), features, and functionality are and will remain the exclusive property of TapHigh and its licensors. All themes, stickers, and Kaomoji collections are protected by copyright, trademark, and other laws.

Any Text Art created by you using the AI feature is considered your original content. However, by generating it, you acknowledge that the underlying AI technology is the property of Google and is subject to their applicable terms.

5. Disclaimers and Limitation of Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis. TapHigh makes no warranties, expressed or implied, regarding the operation or availability of the App or the content, information, and materials included therein.

In no event shall TapHigh, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

6. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

7. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.
